In no case shall Pets Roulette, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. You agree to indemnify, defend and hold harmless Pets Roulette and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

 Pets Roulette Dog Walking & Pet Sitting Service Policies

At Pets Roulette, we are committed to providing the highest quality of care for your pets while respecting your home and belongings. To ensure a smooth experience for both you and your pet, please review and agree to the following policies, which cover all necessary legal aspects under Australian law.

Acceptance of Terms 

By booking and using the dog walking and pet sitting services of Pets Roulette, the client agrees to be bound by the following terms and conditions. These terms are a requirement for the provision of any services by Pets Roulette, and the client acknowledges that no services will be provided unless these terms are accepted. 

  1. Behavioral and Aggression Disclosure: 
    The client agrees to disclose any known behavioral, aggression issues or histories their pet may have with other animals, humans, toys, or food. The client is solely responsible for any harm or injury caused by their pet while under the care of Pets Roulette. 

  1. Pet Health and Vaccination Requirements: 
    The client agrees that all pets accepted by Pets Roulette must be in good general health. The client must provide veterinary information and proof of all required vaccinations during the initial consultation and immediately upon any changes. Pets must be on a flea and tick prevention program while under our care or flea & tick free. 
    Pets Roulette is not liable for any injuries, illness, paralysis tick, canine influenza, loss, or damages of any kind that may occur to the pet while in our care. We care for every pet like they are our own so we don’t take this lightly. 

  1. Health Emergencies and Veterinary Care: 
    In the event that a pet becomes ill or injured, Pets Roulette reserves the right to administer necessary aid and, if necessary, transport the pet to a veterinarian. The client is responsible for all associated costs. While Pets Roulette will attempt to contact the pet's primary veterinarian, the company reserves the right to take the pet to an alternative vet if necessary. 

  1. Payment Terms: 
    The client agrees to pay any invoiced amounts within seven days of receiving the invoice. Invoices not paid within this timeframe will incur interest at a rate of 12% per annum, calculated daily. In addition, Pets Roulette may recover any administrative costs related to debt recovery, including legal fees and a $20.00 fee for issuing recovery notices. 

  1. Cancellations and Access: 

  1. Any scheduled dog walks or pet sitting services cancelled after 5 p.m. the day before the service will be charged at the full rate. 

  1. There is no charge for cancellations made before 5 p.m. the day before. 

  1. If we are unable to gain access to the pet on the scheduled day, the service will still be charged at the full rate. 

  1. Pre-Service Requirements: 
    Before any pet sitting or dog walking services can be provided, a meet-and-greet between the pet owner and the pet sitter is required. This ensures compatibility, allows the sitter to assess any special needs, and provides an opportunity for the owner to disclose important pet behaviors. 

  1. Full Disclosure of Pet Behaviors: 
    The client is responsible for disclosing all known behaviors of their pet that could affect the safety of the pet, the sitter, or property. This includes aggressive tendencies, destructive behaviors, or any other quirks that may pose a risk during the pet sitting or dog walking service. 

  1. Property Damage and Home Assessment: 
    The client agrees to inform Pets Roulette of any potential risks of damage their pet may cause to furniture or household items, including chewing, scratching, or marking. A pre-service home assessment will be conducted to document the condition of the furniture and flooring. Any pre-existing damage will be agreed upon by both parties. 

  1. Cleaning Policy: 
    While Pets Roulette will clean up messes directly caused by the pet (e.g., accidents, food mess), general housekeeping duties such as vacuuming, dishwashing, or other chores unrelated to pet care are not included in our services. 

  1. Emergency Situations: 
    In the event of an emergency involving the pet’s health or safety, the sitter will take appropriate action, including seeking veterinary care. The client will be responsible for all costs incurred as a result of such emergency care.

  2.  11. Pet Sitting and Dog Walking Rates: 
    The following rates apply to our services: 
    1. Quick Check-In: $25 (up to 30 minutes, including a free 15-minute walk) 
    2. Half Day: $60 (up to 4 hours, including a free walk) 
    3. Full Day: $90 (up to 6 hours, including a free walk) 
    4. 30 Minute Walk: $25 
    5. 90 Minute Walk: $40 
    6. Overnight: $120 for dogs or $60 for cats 

  3. Discount Packages 
    o 3-day Package: 10% off 
    o 5-day Package: 15% off 
    o 7-day Package: 25% off 

  4. Trading Hours
    Work hours are between 8am-8pm. If you choose to use our services outside these hours or to set your own time our base rate will become $30 per hour. By proceeding with the booking of any dog walking or pet sitting services with Pets Roulette, the
    client acknowledges and agrees to the terms and conditions outlined above. These terms are a prerequisite for the provision of services, 
    and no services will be rendered unless the client agrees to them in full.

  5.  Services 
    Pets Roulette provides pet sitting and dog walking services designed to meet the unique needs of each pet. Our services include:  
    Pet Sitting Services: 
    • Half Day Pet Sit (4 hours): 
    Our half-day pet sitting service is perfect for pets needing care and attention while you're away for a few hours. This service includes all necessary feeding, watering, exercise requirements, and cleaning up after your pet. We also address toilet needs and ensure that your pet receives one-on-one development time to help them get the most out of their time with us. 
    • Full Day Pet Sit (6 hours): 
    Our full-day pet sitting service provides comprehensive care throughout the day, including feeding, watering, exercise, medication administration (if necessary), and cleaning after your pet. We offer one-on-one development time, taking extra care for pets with anxiety, developmental concerns, or special needs. We work closely with your pet to ensure their comfort, security, and happiness. 
    Dog Walking Services: 
    • Dog Walking: 
    Here at Pets Roulette, Our team has thoroughly researched what is optimal for all dogs' health. Our dog walking services are flexible and personalized to your pet's needs. We include free pick-up and drop-off for each walk, or we can come directly to your location. We can accommodate walks at preferred locations such as beaches and dog parks, upon request. Whether it’s a leisurely walk or an energetic run, we ensure your pet receives the necessary exercise and stimulation. 
    Dog Walking Options 
    • We would recommend our thirty-minute option for pups, beginners, old dogs and for those dogs who prefer the couch. It’s important for your dog's longevity and happiness to receive at least thirty minutes of exercise and joy per day! 
    • Our ninety-minute option is perfect for Dogs who are bursting with energy or tend to feel lonely. Through research and vet recommendations, we know it will be best for your dog to have a thirty-minute walk followed by a thirty-minute break before concluding with a final thirty-minutes of exercise. 
    We understand that not all dogs will appreciate walking consistently, so we are always happy to take along their favorite toy and/or treats to keep them stimulated. Most dogs require patience on a walk so they can enjoy the sights and the smells, these options will allow your dog to get the best walking experience there is to offer. 
    Training Reinforcement: 
    We offer reinforcement for basic training as part of our pet sitting and dog walking services. If your pet is undergoing training, we are happy to continue reinforcing commands and good behaviors or help with any specific behavioral goals. This service is personalized to your pet’s needs. 
    Additional Services: 
    • Quick Check-Ins: 
    Quick check-ins a brief service (up to 30 minutes) to ensure your pet is fed, watered, and comfortable. This is a good option for busy pet owners and if you are going away on holiday.  
    • Overnight Stays: 
    An overnight stay can either be at your home residence or we can host your pet if they are trained. This will allow your pet to be anxiety free and continue with their nightly routine as normal, even if you won’t be home to do so! 
    What Makes us Different: At Pets Roulette, once you have chosen your service through us you will always have the same person and routine, this ensures that your pet feels familiar, loved and secure with 
    us for all occasions. We offer a tailored service to each pet, treating them as if they were our own. No matter the age, size or development stage, we take the time to understand what your pet needs. 

Specialized Care for Pets with Anxiety or Developmental Issues: 

We take extra care with pets that have anxiety or developmental concerns. With the client's approval, we provide additional mental stimulation, training, and calming techniques to help your pet feel more at ease. Our team is experienced in handling pets with anxiety, and we will work on making them feel less stressed and more comfortable during their time with us. 

Personalized Pet Plans: 

At Pets Roulette, we recognize that every pet is unique. For pets with specific needs (such as anxiety or special developmental challenges), we create personalized care plans to address those needs. We will work with you to ensure your pet receives the appropriate care, whether it’s through extra training sessions, calming exercises, or the administration of supplements (with client approval). 

Client Responsibility: 

It is the client’s responsibility to provide all necessary materials for the successful delivery of our services, including: 

  • Medications 

  • Harnesses or leashes 

  • Food and feeding instructions 

  • Any other specific tools or instructions necessary to meet the needs of the pet 

Booking and Scheduling: 

At this time, all services must be booked via email or phone. While we strive to be as flexible as possible, please note that this booking process is subject to change in the future. 

 

Punctuality and Time Management: 

Pets Roulette operates on a strict time basis, and we prioritize punctuality. We are committed to arriving on time for each service, ensuring that your pet receives the attention and care they need when they need it. 

Pick-Up and Drop-Off Services: 

We offer free pick-up and drop-off for all dog walking services, making it easier for you to fit pet care into your busy schedule. For pet sitting, we are happy to visit your home directly, but pick-up and drop-off can be arranged if needed. 

We are dedicated to providing the best care for your pets, ensuring that each service is tailored to their specific needs and preferences. If you have any questions or specific requests, please don’t hesitate to contact us. 

 

Payment and Cancellation Policy  

  1. A 50% deposit is required upon booking our services to secure the appointment. 

  1. The remaining balance must be paid prior to or upon the commencement of services, depending on the client’s preference. 

  1. For services on public holidays, an additional 15% surcharge will be applied to the total cost. 

  1. Cancellation Policy: 

  1. Cancellations before 5 p.m. the day prior to the service: No cancellation fee will apply. 

  1. Cancellations after 5 p.m. the day prior to the service: The full service fee will be charged, and the client will be required to pay the full amount. 

We appreciate your understanding and cooperation in adhering to these payment and cancellation terms. If you have any questions, please do not hesitate to reach out. 

Medical Release and Emergency Authorization 

  1. Primary Veterinarian Information: 
    The client is required to provide the name and contact details of their primary veterinarian on the Pet Information Sheet, which must be completed and submitted prior to the commencement of services. This information is vital in case of any emergency situations that may arise while the pet is under the care of Pets Roulette. 

  1. Emergency Protocol: 
    In the event of an emergency involving the pet’s health or safety, Pets Roulette will make every reasonable effort to immediately contact the client. If we are unable to reach the client, we will first attempt to contact the primary veterinarian listed on the Pet Information Sheet. 

If the primary veterinarian is unavailable due to overbooking or other reasons, Pets Roulette reserves the right to contact an alternative veterinarian or emergency animal hospital. The client acknowledges and agrees to cover all costs associated with emergency veterinary care, regardless of the veterinarian chosen. 

  1. Medical Decisions in Absence of Contact: 
    If the client cannot be reached in an emergency situation, the client grants permission to Pets Roulette to make all medical decisions in the pet's best interest. This includes, but is not limited to, the administration of necessary treatments, procedures, or transport to a veterinary facility. 

  1. Do Not Resuscitate (DNR) Clause: 
    If the client has specific instructions for end-of-life care, including a Do Not Resuscitate (DNR) clause or other special instructions, these must be clearly stated in writing and on file with the primary veterinarian. If the client wishes for Pets Roulette to be aware of these instructions, they must notify us in advance and provide written confirmation from their veterinarian. Without these prior acknowledgments, Pets Roulette will make decisions based on the pet's immediate medical needs, always prioritizing their health and well-being. 

  1. Vaccinations and Health Compliance: 
    The client confirms that their pet is in good general health and up-to-date on all necessary vaccinations required by animal law. The client agrees to provide proof of vaccination (e.g., Rabies, Parvovirus, Distemper, etc.) prior to services being rendered. If any vaccinations are required during the period of care, the client agrees to take responsibility for ensuring that these requirements are met. Failure to provide appropriate vaccination documentation may result in the refusal of services until the required vaccinations are provided. 

  1. Authorization for Emergency Treatment: 
    The client acknowledges that in the case of a medical emergency, they are authorizing Pets Roulette to take all necessary steps to ensure the pet’s well-being. This includes transportation to a veterinary facility, the administration of emergency care, and any treatments deemed necessary by the veterinarian. All associated costs will be the responsibility of the client. 

  1. Liability for Medical Costs: 
    The client agrees to assume full responsibility for any veterinary costs that arise during the pet's care by Pets Roulette, including emergency care. Any outstanding medical fees incurred as a result of the pet's medical emergency must be paid promptly upon receipt of an invoice from the veterinary clinic or hospital. 

Veterinarian Release Form 

I, the Client, authorize Pets Roulette and its representatives to act on my behalf in the event of a medical emergency involving my pet. I understand that they will make every attempt to contact me, but in the event they cannot reach me, Pets Roulette is authorized to seek immediate veterinary care and make medical decisions for my pet, including transportation to an emergency animal hospital, at my expense. I have provided the contact details of my primary veterinarian below, and if they are unavailable, Pets Roulette is authorized to contact another veterinarian of their choice. 

Property Access and Incident Management 

  1. Property Access: 
    The Client must arrange a spare key to leave with the sitter, trusted neighbour or agree to  hide the key in a safe place on the property to provide services. In the event that the property is inaccessible due to a faulty lock, key malfunction, or any other unforeseen circumstance, the client grants Pets Roulette the right to engage a locksmith to perform the necessary services to access the property and carry out the pet sitting or walking services. The cost of such services will be the responsibility of the client and must be reimbursed to Pets Roulette upon presentation of a valid invoice. 

  1. Incidents During Pet Sitting: 
    If any incident occurs at the property during a pet sitting service (e.g., damage to the property, plumbing issues, electrical problems), Pets Roulette will make every reasonable effort to contact the client immediately. We will take all appropriate steps to manage the situation and rectify the issue. The client agrees that if necessary, Pets Roulette is authorized to engage a plumber, handyman, or electrician, as long as the service provider is one with whom the client is familiar. 

If the client’s preferred service providers are unavailable, the client grants Pets Roulette the right to make decisions regarding the repair or maintenance of the property in the best interest of ensuring the pet's safety and the property’s upkeep. Any costs incurred for these services will be the responsibility of the client and reimbursed to Pets Roulette promptly. 

 

Termination of Contract 

Both the client and Pets Roulette reserve the right to terminate this agreement at any time, with or without cause, by providing written notice to the other party. Termination does not relieve the client of the responsibility for any outstanding payments for services rendered up to the point of termination. 

Governing Law 

This contract shall be interpreted and governed under the laws of Australia. Both parties agree to comply with all applicable laws, regulations, and requirements set forth by relevant authorities.
